Please read these Terms of Service ("Terms") carefully before using dealetter.com (the "Service") operated by Dealetter ("we", "us", or "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or otherwise accessing the Service, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and accept these Terms in full. If you are acting on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

Dealetter is a subscription-based SaaS platform that provides newsletter creators with a CRM and AI-powered automation tools. Features include subscriber management, segmentation, AI-assisted content workflows, and analytics — all accessible via the web application at dealetter.com.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

3. User Accounts

To access most features of the Service you must register for an account. You agree to:

Provide accurate, current, and complete information during registration.
Keep your password confidential and not share it with any third party.
Notify us immediately at support@dealetter.com if you suspect any unauthorized use of your account.
Accept full responsibility for all activities that occur under your account.

We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

4. Acceptable Use

You agree not to use the Service to:

Violate any applicable local, national, or international law or regulation.
Send spam, unsolicited messages, or any form of bulk commercial communications.
Upload or distribute malware, viruses, or any malicious code.
Scrape, crawl, or otherwise extract data from the Service without our prior written consent.
Attempt to gain unauthorized access to any part of the Service or its related systems.
Harass, abuse, or harm another person or entity.
Impersonate any person or entity or misrepresent your affiliation with any person or entity.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision.

5. Subscription and Payments

The Service is offered under the following plans:

Free plan: Limited features available at no cost. No credit card required.
Pro plan: Full feature access at €29 per month, billed monthly.

All payments are processed securely through Stripe. By providing your payment information you authorize us to charge the applicable fees to your payment method on a recurring basis until you cancel your subscription.

Subscription fees are non-refundable except where required by applicable law. You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with at least 30 days' prior notice.

6. Intellectual Property

The Service and all of its original content, features, and functionality — including but not limited to software, text, graphics, logos, and interface design — are and will remain the exclusive property of Dealetter and its licensors, protected by copyright, trademark, and other intellectual property laws.

Your data is yours. You retain full ownership of all content and data you upload, import, or create through the Service ("User Content"). By using the Service you grant us a limited, non-exclusive, royalty-free licence to store, process, and display your User Content solely to the extent necessary to provide the Service to you.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Dealetter and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of, or inability to use, the Service.

In no event shall our total cumulative liability to you exceed the greater of (a) the amount you paid to us in the twelve months preceding the event giving rise to the claim or (b) €50.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions our liability is limited to the fullest extent permitted by law.

8. Termination

We may suspend or permanently terminate your access to the Service, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent or abusive behaviour, or if required to do so by law.

Upon termination, your right to use the Service will immediately cease. You may request an export of your User Content before termination takes effect by contacting support@dealetter.com. We reserve the right to delete your data after a reasonable retention period following account closure.

9. Changes to Terms

We reserve the right to update or modify these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page and, where the changes are material, notify you by email or via an in-app notification. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
